The decree banning domestic flights when the train journey is possible in less than 2:30 was published on Tuesday in the Official Journal. The text specifies the methods of application of this measure. The symbolic provision of the 2021 climate law, which is the cancellation of domestic flights when the train journey is possible in less than 2:30, has now been enacted. The measure, which has been given the green light by the European Commission and the Council of State, is the subject of a decree published on Tuesday in the Official Journal. “Regular public passenger air transport services prohibited by Article L.6412-3 of the Transport Code are those for which a replaceable rail connection ensures a journey of less than two and a half hours in each direction (…)”, the text specifies. “This measure is a world first, fully consistent with the government’s policy of promoting the use of modes of transport that emit less greenhouse gases,” Clément Beaune responded to BFMTV. The Minister of Transport “welcomed the publication of the decree”, a “fundamental step” and a “strong symbol” to “achieve carbon neutrality” and decarbonise transport, which still accounts for 30% of emissions”. Exceptions mentioned in the text. This ban, established by the Climate and Resilience Act of 22 August 2021, which is already in practice, has been suspended for the duration of an in-depth investigation by the European Commission following a complaint from part of the aviation sector, which considered it to be contrary to the principles of free service and unsuitable for the fight against climate change. Please note that the ban does not apply to flights with a transfer. All other domestic flights of less than 2.5 hours will not be cancelled. The decree specifies the scope of the measure and states that "the journey must be made between stations serving the same cities as the airports concerned. However, if the more important of the two airports, in view of the average traffic recorded in the past, seven years, is served directly by high-speed rail, the station taken into account (…) is the station serving that airport".
