However, in 2025, the European Green Deal and the Corporate Sustainability Reporting Directive (CSRD) will become<!--more--> key turning points. For legal professionals in the energy sector, this means the need to navigate the changing landscape not only to ensure compliance, but also to support truly sustainable growth.<\/p>\n<p><strong>Understanding the regulatory framework<\/strong><\/p>\n<p>The European Green Deal is the EU&#039;s roadmap to achieve climate neutrality by 2050. It is an ambitious goal that drives legislation to support more sustainable energy. Its key pillars include the &quot;Fit for 55&quot; package and the Energy Efficiency Directive.<\/p>\n<p>The \u201cFit for 55\u201d package aims to reduce emissions by 55 % by 2030 compared to 1990 levels. Recent updates focus on reducing methane emissions, which are present in the production, processing, transport, distribution and storage of fossil gas and oil. In addition, <strong>Renewable Energy Directive (RED III)<\/strong>, the EU&#039;s main legal framework for renewables, sets a binding target for renewable energy of at least 42.5 % by 2030, with a realistic expectation of reaching 45 %. The directive also simplifies Power Purchase Agreements (PPAs) and supports the transition to a cleaner and more sustainable energy system. At the same time <strong>Energy Efficiency Directive<\/strong> sets binding targets to reduce energy consumption by 11.7 % by 2030 compared to 2020 projections and promotes the principle of \u201cenergy efficiency first.\u201d Legal teams must interpret these guidelines and guide organizations to make the necessary changes.<\/p>\n<p><strong>Impact of CSRD on the sector<\/strong><\/p>\n<p>While the Green Deal focuses on climate targets, the CSRD expands reporting requirements. Around 50,000 companies, including non-European entities with significant operations in the EU, are subject to detailed ESG disclosures. A key part is the principle of <strong>&quot;dual materiality&quot;<\/strong>, which requires companies to assess and report not only on how sustainability issues impact their business results, but also on how their activities impact people and the environment. This broad scope requires legal teams to manage reputational, operational and regulatory risks.<\/p>\n<p>CSRD requires <strong>external verification of sustainability reports<\/strong>, which increases accountability and reliability of disclosed information and helps prevent \u201cgreenwashing.\u201d Although sectors such as oil, gas and power generation are not yet affected by the ESRS\u2019s industry-specific standards, they must remain vigilant as these rules are on the way.<\/p>\n<p><strong>Challenges for legal teams<\/strong><\/p>\n<p>Legal teams in the energy sector face increased administrative burdens and the need for collaboration between teams to ensure accurate ESG data. The risk of non-compliance is particularly high as the energy sector is at the center of the implementation of these regulations. In addition, <strong>Clean Industrial Deal<\/strong> The Clean Industry Pact, a follow-up to the Green Deal, is mobilising over \u20ac100 billion to support industrial decarbonisation and clean technologies. Lawyers need to understand these state aid schemes and ensure compliance with regulatory requirements.<\/p>\n<p><strong>Strategic legal responses and best practices<\/strong><\/p>\n<p>For successful adaptation, it is crucial <strong>integrate ESG criteria into corporate governance<\/strong> and ensure that internal policies are in line with regulatory requirements and sustainability goals. It is also important <strong>anticipate regulatory changes<\/strong> through monitoring systems and participation in sectoral discussions.<\/p>\n<p><strong>Use of technology<\/strong> is essential to effectively meet growing ESG obligations. Tools like contract management (CLM) systems help manage ESG clauses, entity management solutions centralize records, and boardroom platforms facilitate transparent decision-making. These technologies enable legal departments to move from being compliance guards to strategic leaders in ESG transformation.
