A small miracle happened on 29 March in New York. A modest campaign that began three years ago at the University of the South Pacific in Vanuatu culminated in the adoption of a UN General Assembly resolution requesting an advisory opinion on climate change from the International Court of Justice. The resolution was a Herculean diplomatic feat by the Vanuatu government. The significance of this achievement lies in the unique contribution that the world\u2019s highest court could make to global action on climate change. By providing authoritative advice to all states, the court could unleash the power of international law to bring about the kind of change that the climate crisis demands. The UN General Assembly asked the court to clarify the legal obligations of countries in relation to climate change, as well as the legal consequences for countries that have caused significant damage to the climate system. The UN General Assembly asked that these questions be answered in the light of a wide range of rules of international law, not just the UN Framework Convention on Climate Change or the Paris Agreement. For the first time in history, the court could clearly and transparently establish the responsibilities of states to protect the climate system, as well as the rights of present and future generations from climate-related harm. The court could further recognize that these harms are disproportionately felt by those least responsible for them \u2013 small island developing states and other countries deemed particularly vulnerable by geography, history of colonization or other factors.
